Terms of use

Launch action required. These terms need the operator identity, commercial terms and professional Hungarian/EU legal review before customer launch. Mandatory consumer rights cannot be excluded by contract.

1. Provider and agreement

The service is provided by [operator legal name], [registered address and registration details] (“DMX.HU”, “we”, “us”). Contact: hello@dmx.hu. By creating an account, accepting an order, or using the console, you agree to these terms and the privacy notice. If you act for an organization, you confirm that you may bind it.

2. Product status and availability

The console is provided on an as-is and as-available basis. It is an internet-dependent software tool, not a managed lighting service or service-level commitment. Availability, uninterrupted operation, latency, frame timing, saved data, compatibility, output delivery and recovery are not guaranteed. Maintenance, faults, capacity limits, security events, network conditions, third-party failures or account controls may interrupt or end access without advance notice.

You must maintain your own current backups, alternative controls and safe shutdown method. Unless a signed order expressly states otherwise, there is no uptime, support-time, restoration-time or data-recovery commitment.

3. Unsupervised and unmanaged networks

The software may be used across networks that DMX.HU does not own, monitor or supervise. Those networks may block, delay, expose or lose control traffic. Connected equipment may retain its last state after communication stops. You accept these conditions and must evaluate the complete network, fixture and fallback path yourself.

Test before every operational use. Confirm addressing, universes, channel maps, latency, disconnect behavior, fail-safe behavior, blackout controls and recovery using the actual network and hardware. Do not assume that a successful browser connection means fixtures will behave safely or correctly.

4. Lighting and operational safety

DMX.HU is not a life-safety, emergency, security, fire, evacuation, medical or industrial safety system. Do not use it where delay, interruption or unintended output could cause death, injury, unsafe crowd conditions, fire, property damage or environmental harm. Keep a competent operator present whenever the installation requires supervision and provide an independent, immediately accessible means to remove power or place the installation in a safe state.

You are solely responsible for rigging, electrical safety, fixture limits, addressing, network design, permissions, regulatory compliance, venue procedures and deciding whether the product is suitable for a use. Follow equipment manufacturers’ instructions and applicable electrical, radio, event and workplace rules.

5. Accounts and security

You must provide accurate account information, keep credentials confidential, restrict access to authorized personnel and promptly report suspected compromise. Accounts are personal unless an order expressly provides an organizational account. One active browser session is permitted per account; signing in again revokes the earlier session.

6. Authorized network use

You may connect only to equipment, networks, accounts and destinations that you own or are expressly authorized to control. You must not bypass access controls, intercept data, disrupt systems, facilitate unlawful activity or direct output to an unauthorized destination. We may restrict activity or suspend accounts to protect users, infrastructure or third parties.

7. Your content and credentials

You retain your rights in show files, cue data and other content you submit. You grant us a limited right to host, copy, process and transmit that content only as needed to provide, secure, back up and support the service. You confirm that you have the necessary rights and that your content and configuration do not violate law or another person’s rights.

Integration credentials you choose to save are processed when establishing the requested connection. Remove them when they are no longer needed and do not reuse secrets across services.

8. Our software and permitted use

Subject to these terms, we give you a limited, non-exclusive, non-transferable, revocable right to access the hosted console for its intended purpose during your authorized account period. No ownership is transferred. Except where mandatory law permits it, you may not resell access, circumvent limits, extract credentials, interfere with the service, or copy protected branding and content.

9. Third-party systems

Art-Net equipment, LightKnight, internet access, hosting networks and other third-party products are outside our control. Their availability, security, compatibility and terms are their providers’ responsibility. Integration does not constitute endorsement or a warranty.

10. Charges, cancellation and consumer information

Prices, taxes, subscription period, payment terms, cancellation rights, renewal, support and any refund terms must be stated in the applicable order before purchase. 11. Suspension and termination

You may stop using the service at any time, subject to an applicable paid order. We may suspend or terminate access when reasonably necessary for security, unlawful or unauthorized use, material breach, non-payment, legal compliance, risk to networks or discontinuation of the service. Where practicable and safe, we will give notice and a reasonable opportunity to export data or remedy a breach. Account termination and deletion follow the privacy notice and mandatory retention duties.

12. Disclaimers

To the maximum extent permitted by applicable law, we disclaim implied warranties of uninterrupted availability, merchantability, fitness for a particular purpose, compatibility, accuracy and non-infringement. You remain responsible for acceptance testing and operational decisions. Nothing in these terms excludes a warranty or remedy that cannot lawfully be excluded, including mandatory consumer rights.

13. Liability

Nothing limits liability that cannot legally be limited, including liability for intentional misconduct, fraud, or death or personal injury where caused by negligence and applicable law prohibits exclusion. Subject to that rule, DMX.HU is not liable for indirect or consequential loss, lost profit, lost revenue, loss of data, loss of opportunity, fixture behavior, show interruption, network failure or the cost of substitute control.

For claims that may lawfully be limited, aggregate liability will not exceed the fees paid for the affected service during the 12 months before the event giving rise to the claim, or another cap expressly stated in the applicable signed order. This limitation does not reduce mandatory rights available to consumers.

14. Changes

We may change the software and these terms for security, legal, technical or product reasons. Material changes will be dated and notified as required by law. Changes will not retroactively remove accrued mandatory rights. If you do not accept a material change, you must stop using the service and may exercise any cancellation right provided by law or your order.

15. Governing law and disputes

These terms are governed by the laws of Hungary, without depriving a consumer of mandatory protections of the country where they habitually reside. Courts with jurisdiction under applicable law will hear disputes. 16. General

If one provision is unenforceable, the remainder continues to apply. Failure to enforce a provision is not a waiver. You may not transfer the agreement without our written consent; we may transfer it as part of a lawful business transfer while preserving applicable rights. These terms, the privacy notice and the applicable order form the agreement concerning the hosted service.
